Terms and Conditions

Please read these terms carefully before accessing or using the BULAMBU platform.

PART A - TERMS AND CONDITIONS

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and BULAMBU ("Company", "we", "us", or "our") governing your access to and use of the BULAMBU mobile application, website, and all related services (collectively referred to as the "Platform").

By registering on, accessing, or using the Platform in any manner, you confirm that you have read, understood, and agree to be legally bound by these Terms. If you do not agree to any part of these Terms, you must immediately discontinue use of the Platform.

1. About BULAMBU

1.1 BULAMBU is a healthcare coordination platform that provides the following services:

  • Emergency Response Coordination:Upon activation of the SOS feature, BULAMBU dispatches the nearest available partner ambulance to the user's location, displays a list of nearby hospitals sourced from publicly available data, and provides real-time updates to designated family contacts.
  • Planned Ambulance Transport: Advance booking of verified partner ambulance services for scheduled medical needs including hospital discharge, procedure transport, and follow-up visits.
  • Medicine Reminders (future service): Daily medication reminders delivered via SMS, WhatsApp, and automated voice call to family members, with caregiver alert notifications.

1.2 BULAMBU is a technology coordination platform and not a medical service provider, hospital, ambulance operator, or healthcare professional. BULAMBU does not employ ambulance crew, medical personnel, or paramedics directly.

1.3 The emergency and planned transport services are currently operational in Panvel, Navi Mumbai, Maharashtra only. Medicine reminder services, when launched, will be available nationally across India.

2. Eligibility

2.1 You must be at least 18 years of age to register for and use the Platform independently.

2.2 If you are registering on behalf of a family member who is a minor or elderly individual, you represent that you have the legal authority to do so and accept full responsibility for their use of the Platform.

2.3 By using the Platform, you represent that all information you provide is accurate, current, and complete, and that you have the legal capacity to enter into this binding agreement.

3. Registration and Account

3.1 You must create an account to access BULAMBU services. You agree to provide accurate and truthful information during registration.

3.2 You are solely responsible for maintaining the confidentiality of your account credentials. You agree to notify BULAMBU immediately at contact@bulambu.in if you become aware of any unauthorised use of your account.

3.3 BULAMBU reserves the right to suspend or terminate your account if any information provided during registration or thereafter is found to be inaccurate, misleading, or fraudulent.

3.4 One account may be used to register up to three (3) family members under a single subscription plan.

4. Subscription Plans and Payment

4.1 BULAMBU operates on an annual subscription model. The following plans are available:

  • BULAMBU Basic plan (Panvel/Navi Mumbai): Includes emergency coordination, planned ambulance booking.
  • BULAMBU Shield Plan (Panvel/Navi Mumbai): Includes emergency coordination, planned ambulance booking, and medicine reminders. Annual subscription fee as displayed on the Platform at time of purchase.
  • BULAMBU Care Plan (All India):Includes medicine reminder services only, available to users outside BULAMBU's emergency service area. Annual subscription fee as displayed on the Platform at time of purchase.

4.2 All subscription fees are charged in Indian Rupees (INR) and are inclusive of applicable taxes unless stated otherwise.

4.3 Payments are processed through secure third-party payment gateways. BULAMBU does not store your full payment card details on its servers.

4.4 Subscriptions are non-refundable once activated, except in the following circumstances:

  • Technical failure on BULAMBU's part resulting in complete inability to deliver the subscribed service for a period exceeding seven (7) consecutive days.
  • Duplicate payment resulting from a verified technical error.

4.5 BULAMBU reserves the right to revise subscription pricing at any time. Existing subscribers will be notified at least thirty (30) days in advance of any price change. Price changes will apply from the next renewal cycle and will not affect the current active subscription period.

4.6 Subscriptions automatically expire at the end of the subscription period unless manually renewed by the user. BULAMBU will send renewal reminders via registered email and SMS.

5. Emergency Coordination Service - Scope and Limitations

5.1 Upon activation of the SOS feature, BULAMBU will:

  • Dispatch the nearest available partner ambulance to the user's GPS-detected location.
  • Display a list of publicly available nearby hospitals for the user's reference and selection.
  • Transmit the selected hospital's location to the ambulance driver via the Platform.
  • Send real-time status notifications to the user's registered emergency contacts.

5.2 CRITICAL LIMITATIONS - PLEASE READ CAREFULLY

  • BULAMBU displays nearby hospitals based solely on publicly available geographic data (such as Google Maps/Google Places API). BULAMBU does NOT verify, represent, or guarantee any hospital's capacity, availability of beds, availability of specialist doctors, equipment status, or suitability for any specific medical condition.
  • The responsibility for selecting a hospital rests entirely with the user. BULAMBU makes no recommendation and accepts no liability for outcomes arising from the user's hospital selection.
  • BULAMBU is dependent on partner ambulance availability. BULAMBU does not guarantee response time and cannot guarantee that a partner ambulance will be available at all times.
  • BULAMBU is a coordination tool and not a substitute for calling government emergency services including 112 (National Emergency Number) or 108 (Ambulance). In any life-threatening emergency, users are advised to also contact government emergency services simultaneously.
  • BULAMBU's emergency coordination service is operational in Panvel and Navi Mumbai only. Users outside this service area who activate SOS will be directed to government emergency numbers and will not receive BULAMBU ambulance dispatch.

5.3 BULAMBU shall not be held liable for any delay in response caused by factors outside its reasonable control including but not limited to traffic conditions, GPS inaccuracies, network connectivity issues, unavailability of partner ambulances, force majeure events, or actions / omissions of third parties.

5.4 BULAMBU does not guarantee or warrant any specific medical outcome as a result of using the Platform. BULAMBU is a logistics and communication coordination service only.

6. Planned Ambulance Transport Service

6.1 Users may book verified partner ambulances in advance for scheduled medical needs through the Platform.

6.2 Bookings are subject to ambulance partner availability and confirmation.

6.3 Cancellations must be made at least two (2) hours before the scheduled pickup time. Cancellations made after this period may be subject to a cancellation fee as communicated at the time of booking.

6.4 BULAMBU acts solely as an intermediary between the user and the ambulance service provider. BULAMBU does not operate ambulances directly and does not employ ambulance crew.

7. Medicine Reminder Service

7.1 The medicine reminder service allows users to set medication schedules for themselves and family members. Reminders are delivered via SMS, WhatsApp message, alarm alert and automated voice call.

7.2 BULAMBU does not provide medical advice. Medicine reminders are based entirely on information entered by the user and are not reviewed, verified, or endorsed by any medical professional.

7.3 BULAMBU does not guarantee delivery of reminders in all circumstances. Delivery may be affected by mobile network availability, device settings, phone status, or third-party messaging platform outages.

7.4 Users and caregivers must not rely solely on BULAMBU reminders for critical medication management. BULAMBU accepts no liability for health consequences arising from missed reminders for any reason.

8. User Obligations

8.1 You agree to use the Platform only for lawful purposes and in a manner consistent with all applicable laws and regulations of India.

8.2 You agree NOT to:

  • Activate the SOS feature for non-emergency or test purposes—false emergency activations may delay response to genuine emergencies and may result in account suspension.
  • Provide false, inaccurate, or misleading information during registration or use of the Platform.
  • Attempt to reverse engineer, decompile, or tamper with the Platform.
  • Use the Platform for any commercial purpose without prior written consent from BULAMBU.
  • Engage in any activity that disrupts, overloads, or impairs the Platform's infrastructure.
  • Misuse the Platform in any way that could harm BULAMBU, its partners, or other users.

9. Third-Party Services and Partners

9.1BULAMBU works with third-party ambulance service providers ("Ambulance Partners") who are independent operators. BULAMBU does not employ these partners and is not responsible for the conduct, competence, or negligence of any Ambulance Partner.

9.2 Hospital listings shown on the Platform are sourced from publicly available third-party data sources. BULAMBU has no formal agreement with any hospital and does not endorse any listed hospital.

9.3 The Platform may use third-party services including mapping services, payment gateways, and communication platforms. Use of these services is subject to their respective terms and privacy policies.

10. Intellectual Property

10.1 All content, trademarks, logos, software, and materials on the BULAMBU Platform are the exclusive intellectual property of BULAMBU and are protected under applicable Indian intellectual property laws.

10.2 You are granted a limited, non-exclusive, non-transferable, revocable licence to use the Platform for personal, non-commercial purposes only. This licence does not constitute a transfer of any intellectual property rights.

10.3 You may not reproduce, distribute, modify, create derivative works of, or commercially exploit any part of the Platform without prior written consent from BULAMBU.

11. Limitation of Liability

11.1To the maximum extent permitted under applicable Indian law, BULAMBU's total aggregate liability to any user for any claim arising out of or in connection with these Terms or use of the Platform shall not exceed the total subscription fees paid by that user in the twelve (12) months preceding the claim.

11.2 BULAMBU shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from use of or inability to use the Platform, including but not limited to loss of life, personal injury, property damage, loss of data, or loss of revenue—whether or not BULAMBU has been advised of the possibility of such damages.

11.3BULAMBU does not exclude liability for death or personal injury caused solely by BULAMBU's own proven gross negligence or wilful misconduct, to the extent such exclusion is not permitted by law.

12. Indemnification

You agree to indemnify, defend, and hold harmless BULAMBU, its directors, officers, employees, partners, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with:

  • Your use or misuse of the Platform
  • Your violation of these Terms.
  • Your violation of any applicable law or third-party rights.
  • Any information you submit through the Platform that is false, inaccurate, or misleading.

13. Disclaimer of Warranties

13.1The Platform is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

13.2 BULAMBU does not warrant that the Platform will be uninterrupted, error-free, secure, or free of viruses or other harmful components.

13.3 BULAMBU does not warrant that emergency services will be available at all times or that response times will meet any specific standard.

14. Termination

14.1 BULAMBU reserves the right to suspend or permanently terminate your account and access to the Platform with or without prior notice if:

  • You breach any provision of these Terms.
  • BULAMBU is required to do so by law or a court order.
  • BULAMBU determines, in its sole discretion, that your conduct is harmful to other users, third parties, or BULAMBU's business interests.

14.2 You may terminate your account at any time by contacting BULAMBU at contact@bulambu.in. Termination does not entitle you to a refund of any subscription fees paid.

14.3 Upon termination, BULAMBU will delete or anonymise your personal data in accordance with its Privacy Policy and applicable data retention obligations.

15. Governing Law and Dispute Resolution

Dispute Resolution, Governing Law and Arbitration

(a) Amicable Resolution. The Parties shall use their respective best endeavours to resolve amicably, in good faith and through bona fide negotiations, any dispute, controversy, difference, claim, counterclaim or disagreement of whatsoever nature... Either Party may, by written notice, require the other Party to enter into consultations, and the Parties shall endeavour to resolve the Dispute within thirty (30) days from the date of receipt of such notice.

(b) Reference to Arbitration. If the Dispute is not resolved within the aforesaid period, the same shall be referred to and finally resolved by arbitration in accordance with the provisions of the Arbitration and Conciliation Act, 1996.

(c) Constitution of Arbitral Tribunal. The arbitral tribunal shall consist of a sole arbitrator, jointly appointed by the Parties.

(d) Seat, Venue and Language. The seat and legal place of arbitration shall be Nagpur, Maharashtra, India... The arbitration proceedings shall be conducted exclusively in English, Hindi and Marathi.

(e) Governing Law. This Agreement, the rights and obligations of the Parties, and all Disputes shall be governed by and construed in accordance with the laws of the Republic of India.

(f) Interim and Conservatory Relief. Nothing contained herein shall prevent either Party from seeking interim or injunctive relief under Sections 9 and 17 of the Arbitration and Conciliation Act, 1996.

(g) Confidentiality. The existence of any Dispute, the arbitral proceedings, all pleadings, evidence, and awards shall be treated as strictly confidential.

(h) Finality and Binding Effect. The arbitral award shall be final, conclusive and binding upon the Parties.

(i) Exclusive Jurisdiction. Subject always to arbitration provisions, the courts at Mumbai, Maharashtra, shall have exclusive jurisdiction.

(j) Survival. The provisions of this Clause shall survive the completion, expiration, performance, or termination of this Agreement.

16. Grievance Officer

In accordance with the Information Technology Act 2000 and the IT (Intermediary Guidelines and Digital Media Ethics Code) Rules 2021, BULAMBU has appointed a Grievance Officer:

17. Changes to Terms

17.1 BULAMBU reserves the right to modify these Terms at any time. Material changes will be communicated to registered users via email and/or in-app notification at least fifteen (15) days before taking effect.

17.2 Your continued use of the Platform after the effective date of revised Terms constitutes your acceptance of those changes. If you do not agree to the revised Terms, you must discontinue use of the Platform.

18. Miscellaneous

18.1 Severability: If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.

18.2 Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and BULAMBU regarding use of the Platform and supersede all prior communications and agreements.

18.3 Waiver:BULAMBU's failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision.

18.4 Assignment: You may not assign your rights or obligations under these Terms without prior written consent from BULAMBU. BULAMBU may assign its rights to a successor entity.
